On Oct. 5, 2026, the Supreme Court heard arguments in a lawsuit Boulder County, Colorado, filed in 2018 in Colorado state court against Suncor Energy and ExxonMobil. The county seeks to recover past and future costs it attributes to climate change, including repairs, emergency services and property damage, and alleges the companies knew decades ago that fossil fuels would hurt the environment. The companies ask the Court to end the case, arguing that only the federal government can address climate change; the Trump administration supports the companies. The Colorado Supreme Court allowed the suit to proceed. Justice Samuel Alito is not participating, so a 4-4 split would leave that ruling in place. More than two dozen similar suits are pending in other courts.
